Licence agreement

1. What this covers

This agreement is between you and Ghostavix ("we", "us"). It covers Ghost Hub, Ghost Browser, Ghost VPN, Ghost Weather, Ghost Volume, Ghost GPS and Ghost Terminal for Android (the "apps"), and Ghost Setup for Windows, together with their updates (all together, the "software"). By installing or using the software, you agree to it. If you don't agree, please don't install or use it.

Buying a key is covered by the Terms of sale.

2. Your licence

The software is licensed to you, not sold. We give you a personal, non-exclusive licence, which you can't transfer to anyone else, to:

• Ghost apps: install and use the apps your key includes on one Android phone or tablet (the one your key is locked to), for your own personal, non-commercial use. A Paid key's licence has no end date.
• Ghost Hub: install and use it on any Android device, to see the apps and install the ones your key includes.
• Ghost Setup: install and use it, free, on Windows PCs you own or are allowed to change.

If you change phones, we'll move your key to the new one: just email us.

3. What's not allowed

Unless the law allows it or we agree in writing, you must not:

• share, lend, sell, rent or give away your key, or let anyone else use it;
• copy the apps and pass them on, put them on other websites or app stores, or pass on changed copies of Ghost Setup (sharing a link to ghostavix.co.uk is always fine);
• remove, turn off or get round the key check, or anything that protects the software;
• change, decompile, reverse-engineer or take apart the software, except where UK law gives you a right to do so;
• remove any copyright or trade mark notices from it;
• use the software to break the law, to harm or deceive others, or to get into devices, networks or accounts you're not allowed to.

4. Using the apps responsibly

• Ghost GPS changes the location your phone reports to other apps, using Android's mock location setting. Only use it where that's lawful and allowed. Many games and apps ban location changing in their own rules and may suspend your account there; that's between you and them. Don't use it to deceive people, commit fraud, or get round safety or tracking features that others rely on.
• Ghost VPN connects through servers run by volunteers for the VPN Gate project. Like any VPN, the server you connect to carries your traffic. Don't use it for anything unlawful.
• Ghost Terminal runs the commands you type, and some commands can change or delete things on your phone.
• Ghost Setup changes Windows settings and can remove apps you choose. Read each switch before you press Start, and keep backups of anything important.

5. Who owns what

We (or the people who license them to us) own the software and all rights in it, including the Ghostavix and Ghost names and logos. You get only the rights this agreement gives you.

Some parts of the software are open-source, made by others and used under their own licences. They're listed on the Open-source licences page, and nothing in this agreement limits the rights those licences give you.

6. Updates

We update the software to fix problems, keep it working with new versions of Android and Windows, and add features. Ghost Hub installs updates when you choose to. Some older versions may stop working with our servers, so keeping the apps up to date is a good idea. Updates may change features, but we won't take away the main thing each app does.

7. Services run by others

Some features rely on services run by other organisations, such as maps, weather forecasts, VPN servers and page translation. They're listed on the Privacy and Open-source licences pages. Those organisations can change or stop their services. If that happens, we'll try to switch to another service, but we can't promise every feature will always be available.

8. Ending this agreement

• You can end it at any time by uninstalling the software.
• We can end your licence, and switch off your key, if you seriously or repeatedly break this agreement, for example by sharing or reselling your key. Where we can, we'll email you first and give you a chance to put it right.
• When it ends, you must stop using the apps and uninstall them. Sections 5 and 10 keep applying.

9. Our promises

The apps you pay for must be as described, fit for purpose and of satisfactory quality. Your rights if they're not, and what we'll do, are in the Terms of sale. Beyond that, and as far as the law allows, the software is provided as it is, and we don't promise it will always be free of faults or available without interruption.

10. Responsibility for loss or damage

Our responsibility for loss or damage is set out in the Terms of sale. For the free software (Ghost Hub on its own and Ghost Setup), and as far as the law allows, we're not responsible for loss or damage unless it's caused by our failing to use reasonable care and skill. Nothing in this agreement limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit.

11. Law

This agreement is governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. Questions? Email hello@ghostavix.co.uk.
